Welcome to Egegu. Egegu operates an app discovery platform accessible at egegu.com (the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms of Service (these “Terms”). If you do not agree to these Terms, you must not access or use the Platform.

1. Acceptance of Terms

By using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. Egegu reserves the right to modify these Terms from time to time. We will provide notice of material changes as permitted by law, and continued use of the Platform after changes become effective constitutes your binding consent to the revised Terms. If you do not agree to the updated Terms, you must discontinue your use of the Platform.

2. Intellectual Property

All rights, title, and interest in and to the Platform, including its design, layout, features, graphics, source code, and all associated intellectual property, are owned by Egegu or its licensors. The Platform and its content are protected by copyright, trademark, and other intellectual property laws. You may access and use the Platform for your personal, non-commercial use as permitted by these Terms. You may not reproduce, modify, distribute, display, perform, or create derivative works from the Platform or any of its content, in whole or in part, without prior written consent from Egegu or the applicable rights holder, except as expressly provided by law or within the Platform’s own features for user interaction.

As between you and Egegu, any user-generated content you upload or submit remains your property or the property of the respective rights holders. By submitting such content, you grant Egegu a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform, and display the content solely for the purpose of operating, promoting, and improving the Platform, consistent with our Privacy Policy and applicable guidelines.

3. Third-Party Links and Google Play Apps

The Platform serves as a discovery conduit that aggregates information about available applications. Some apps listed on Egegu are hosted and distributed through the Google Play Store. Egegu does not host these apps on its own servers, nor does it sell or directly distribute the apps. When you click through to view or install an app, you will be redirected to Google Play, and you will be subject to Google Play’s Terms of Service and Privacy Policy.

Egegu strives to provide accurate and up-to-date information about third-party apps; however, Egegu does not guarantee the availability, security, functionality, or legal compliance of any app offered on Google Play or elsewhere. Egegu is not responsible for the content, accuracy, or privacy practices of third-party sites or services, and inclusion of any third-party link does not imply endorsement by Egegu. If you access third-party apps through the Platform, you acknowledge and agree that your use of those apps is governed by the terms and privacy policies of the third party provider (for Google Play, Google’s Terms and Privacy Policy).

4. Disclaimers

THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE EXTENT PERMITTED BY LAW, EGEGU AND ITS AFFILIATES, LICENSORS, AND PARTNERS MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR TITLE. EGEGU DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM DEFECTS. INFORMATION PRESENTED ON THE PLATFORM IS FOR GENERAL INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE ADVICE OR A RECOMMENDATION.

YOUR USE OF THE PLATFORM AND ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE PLATFORM IS DONE AT YOUR SOLE RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM SUCH DOWNLOAD OR USE.

5. Limitation of Liability

IN NO EVENT SHALL EGEGU OR ITS AFFILIATES, LICENSORS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF EGEGU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE GREATER OF USD 100 OR THE AMOUNT PAID, IF ANY, BY YOU TO EGEGU FOR THE USE OF THE PLATFORM IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

6. Termination

We may suspend or terminate your access to the Platform at our sole discretion, with or without cause and with or without notice. Upon termination, all rights granted to you under these Terms cease immediately, and you must discontinue use of the Platform. Provisions intended to survive termination shall survive, including ownership, warranties, and limitations of liability.

7. Privacy

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Egegu is incorporated, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of such courts to resolve any disputes arising out of or relating to these Terms.

9. Changes to These Terms

We may update these Terms from time to time. We will post the effective date of the latest revision at the top of this page and, where required by law, provide notice. Your continued use of the Platform after the updated Terms become effective constitutes your acceptance of the revised Terms.

10. General Provisions

If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect. Nothing in these Terms shall be construed as creating any agency, partnership, joint venture, or employment relationship between you and Egegu. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged by us in writing.
